Access to and use of Beyond the Board’s Website and the products and services available through the Website (henceforth “Services”) are subject to the following terms, conditions and notices (the “Terms and Conditions of Service”). Accessing The Website is permitted on a temporary basis, and Beyond the Board reserve the right to amend or withdraw the Services without notice. You are not permitted to publish, manipulate, duplicate, copy, sell, distribute or otherwise reproduce or exploit, in any format, any of the content or copies of the content supplied to you or which appears on The Website nor may you use any such content in connection with any business or commercial enterprise.

USER CONTRIBUTIONS

Users of the Website may post public comments on the site. By posting publicly on the Website you agree not to act illegally or violate these Terms and Conditions of Service.

TERMS OF SALE

The Terms and Conditions of Service govern the sale of goods available on the Website, including all products listed as being out of stock. When placing an order you accept you are entering into a contract of sale with Beyond the Board and as a result subject to the following terms and conditions.

All orders are subject to confirmation of the order price and availability.

Dispatch times are subject to stock availability, any representations and or guarantees made with respect to shipment times are subject to any delays resulting from force majeure or postal issues, for which we will not be held liable.

To enter into contract with Beyond the Board you must be of at least the age of majority in your state, province or territory of residence, or the age of majority in your state, province or territory of residence and have given us your consent to allow any of your dependent minors to access and use this site. You must be in possession of a valid credit or debit card issued by a bank to you, acceptable to Beyond the Board. Beyond the Board retains the right to refuse any request made by you or your representatives.

Contract:

Upon placing an order, you will receive an email confirming receipt of your order, this email does not establish acceptance of your order. A contract between us for the purchase of the goods is not formed until your payment has been approved by Beyond the Board and we have debited your credit or debit card.

Pricing and Availability:

While we strive to assure all descriptions, details and prices appearing on The Website are accurate, errors (including system-syncing or processing errors) can occur. If we discover an error with the description, price or payment of any goods you have ordered, we will inform you as promptly as possible and offer you the options to reconfirm your order at the correct price or correct item, or cancel it. In the event we are unable to contact you we will treat the order as cancelled. If the order is cancelled and you have already paid for the product/s, you will receive a full refund in Australian Dollars (AUD).

Beyond the Board reserves the right to cancel, at any time before delivery and for whatever reason, a previously accepted order. Beyond the Board may do this for example, but without limitation, where:

  • Beyond the Board’s suppliers are unable to supply services that they have previously promised to supply;
  • An event beyond Beyond the Board’s control, such as storm, fire, flood, earthquake, terrorism, power failure, war, strike or failure of computer systems, means that Beyond the Board is unable to supply the services within a reasonable time;
  • Services ordered were subject to an error on The Website, for example, in relation to a description, price or image, which was not discovered prior to the order being accepted;
  • Services ordered are subject to specific quantity limits set out by us;
  • You ask Beyond the Board to cancel your order.

Where pertinent, prices are GST inclusive. Costs of delivery are charged in addition and all costs will be clearly presented where germane and included in the “Total Cost” at checkout.

Our Services may contain errors or inaccuracies and may not be complete or current. As such we reserve the right to correct any errors, inaccuracies or omissions, to alter or update information at any time without notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may be or contain inaccuracies or errors.

Beyond the Board’s prices are subject to change without notice. We reserve the right to modify or discontinue our Services (or any part or content thereof) without notice at any time.

Payment:

Our website transactions are made in Australian Dollars ($AUD). Our website accepts payments using Visa, MasterCard Google Pay and Apple Pay. Once your payment method has been validated, upon clicking “Place Order” we will debit the funds from your nominated form of payment immediately for the full order amount.

Beyond the Board will not be held liable for loss of funds resulting from currency conversion during the process of issuing a refund or store credit, for any reason, in currencies other than AUD.

From time to time Beyond The Board may offer coupon discount or free shipping promotion codes. These codes may apply to general shopping or specific items purchased at The Website. The terms of use of promotion codes will be clearly stipulated at the time of issue.

Beyond the Board and the owner, officers, agents, employees, subsidiaries, and affiliates will not be held liable for any actions including but not limited to, claims, losses, damages, liabilities and expenses including legal fees from your use of The Website.

The material displayed on The Website is provided without any guarantees, conditions or warranties as to its accuracy.

LINKING TO THIS WEBSITE

You may link to The Website, provided you do so in a way that is fair and legal and does not damage or take advantage of our reputation. You must not establish a link in such a way to suggest any form of association, approval or endorsement where none exists.

You must not establish a link from any website that is not owned by you.

The Website must not be framed on any other site. We reserve the right to withdraw linking permission without notice.

Beyond the Board shall retain the right at its absolute discretion at any time and without notice to amend, remove or alter the Services and/or any page of The Website.

GOVERNING LAW AND JURISDICTION

These Terms and Conditions of Service are governed in accordance with the laws of Victoria, Australia, in the event of any dispute or claim associated with these Terms and Conditions of Service, that dispute or claim shall be subject to the exclusive jurisdiction of Victoria, Australia.

SEVERABILITY

If at any time any of the provisions set forth in these Terms and Conditions of Service are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions of Service. All other provisions will not be affected by the removal and the remaining of these Terms and Conditions of Service will still be considered valid.

COMPLETE AGREEMENT

The above Terms and Conditions of Service constitute the complete agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Beyond the Board.
